Did you know that you automatically lose your VA license if you are arrested for DUI in Virginia? This is called an administrative suspension of the driver's license. If your blood alcohol level (BAC) is 0.08 percent or more, or you refuse to conduct a chemical test at the request of the officer, they may take your driver's license with you. If this is your first offense, your license will be suspended for seven days. If this is your second offense, the suspension will take 60 days or until your court date (whichever comes first). The only exception is if you were stopped on private property. Then the law of implied consent does not apply. This license suspension is independent of any criminal charges.
From the very first offense, you may be sentenced to prison, heavy fines, compulsory "DUI School" and a one-year loss of your license. In most cases, the judge will give a limited license for a first offense.
